ADULT INFORMED CONSENT, ASSUMPTION OF RISK AND LIMITED RELEASE OF LIABILITY

IMPORTANT — READ BEFORE ACCEPTING

THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS. SUBJECT TO THE EXPRESS EXCEPTIONS BELOW, IT RELEASES CERTAIN CLAIMS ARISING FROM RED LIFE'S NEGLIGENCE, INCLUDING CLAIMS INVOLVING PERSONAL INJURY OR PROPERTY DAMAGE.

YOU KEEP ALL RIGHTS THAT CANNOT LAWFULLY BE EXCLUDED, INCLUDING APPLICABLE CONSUMER RIGHTS TO COMPETENT SERVICES, STATUTORY REFUNDS AND OTHER MANDATORY REMEDIES.

Read the entire agreement. Ask questions if anything is unclear. You may decline to participate and may stop a session at any time. This agreement does not establish that a session is medically suitable for you or that every risk can be prevented.

1. WHO AND WHAT THIS AGREEMENT COVERS

"Red Life" means Red Life Therapy Inc., carrying on business as Red Life Wellness.

"Released Parties" means Red Life and its directors, officers, employees, attendants, agents and contractors, but only in connection with their duties in providing or operating the services covered by this agreement. It does not automatically include independent equipment manufacturers, suppliers, insurers, landlords or unrelated businesses.

"Sessions" means Red Life's non-medical red-light and near-infrared LED wellness sessions and associated screening, instruction, supervision, equipment use, entry, exit and use of waiting, changing and session areas.

This agreement does not authorize materially different services or equipment risks without appropriate additional disclosure and consent.

2. AGE, CAPACITY AND VOLUNTARY PARTICIPATION

I confirm that I am at least 19 years old, am accepting for myself and can understand this agreement and make this decision. I am not accepting while impaired or otherwise unable to give meaningful consent.

I have an opportunity to read the agreement and ask questions before accepting. If I need assistance understanding the document or using the booking process, I will request it before accepting.

I understand that Red Life may require acceptance before providing a session. If Red Life first presents this agreement, or a materially revised agreement, after I have prepaid and I decline it, Red Life will refund the amount attributable to unused services I cannot access because of that refusal, without a waiver-refusal penalty. This does not reduce any greater refund or cancellation entitlement I have under law.

3. NATURE AND LIMITS OF THE SERVICE

Red Life provides non-medical wellness services. These sessions are not medical assessment, diagnosis, treatment or monitoring and are not a substitute for care from an appropriate regulated healthcare professional.

No particular improvement in appearance, sleep, circulation, recovery, pain, weight, mood or any other outcome is guaranteed. Experiences and responses differ.

Red Life's screening identifies information that may require further review. A completed questionnaire, accepted waiver, booking confirmation, previous uneventful session or staff discussion does not establish medical suitability or guarantee safety.

I will seek advice from an appropriate healthcare professional where my health, medication or circumstances raise concerns. I will not delay needed healthcare or change prescribed treatment because of a session or a statement about it.

Nothing in this section removes rights arising from misleading representations or legally enforceable service promises.

4. SCREENING AND CHANGES IN MY HEALTH

I will answer screening questions honestly and completely to the best of my knowledge. If I do not know an answer, I will say so rather than guess or select "no" to proceed.

Before participating, and whenever information changes, I will disclose relevant concerns, including:

  • Pregnancy, possible pregnancy or related concerns.
  • Photosensitivity, medication, supplements or topical products that may affect response to light or heat.
  • Skin conditions, unusual lesions, cancer history, burns, wounds, infections, recent tanning, surgery or cosmetic procedures.
  • Eye disease, recent eye surgery, vision changes or significant light sensitivity.
  • Seizures, neurological conditions, fainting, circulation problems, reduced sensation or difficulty recognizing heat or discomfort.
  • Implanted or electronic medical devices.
  • Illness, fever, dehydration, impaired mobility, difficulty entering or leaving equipment, anxiety or claustrophobia.
  • Any healthcare advice to avoid light, heat or the proposed activity, and any other reason I am uncertain about participating safely.

These are matters for disclosure and appropriate review; they are not a statement that every listed circumstance automatically prohibits participation.

I will report changes before my next session, including changes after making a booking. If something has changed or I am unsure, I will not proceed until the concern has been reviewed and any required further advice obtained. A previous clearance does not override a new concern.

Providing information or obtaining healthcare advice does not remove Red Life's own duties to assess what it can safely provide and follow applicable equipment instructions.

5. RISKS I SHOULD UNDERSTAND

Red and near-infrared light exposure and use of the premises are not risk-free. An absence of UV does not mean an absence of skin, eye or thermal risk. Potential risks include:

  • Warmth, sweating, overheating, dehydration, discomfort, burns, blistering or other thermal injury.
  • Redness, dryness, irritation, rash, itching, tenderness, pigmentation changes, scarring or other skin injury.
  • Eye strain, headache, light sensitivity, visual disturbance or eye injury, including potentially lasting harm.
  • Dizziness, fainting, nausea, loss of balance, anxiety, panic or claustrophobia.
  • Photosensitive or other unexpected reactions involving medication, supplements, skincare products or an existing condition; aggravation of symptoms or conditions.
  • Contact irritation or allergic reactions to cleaning agents, surfaces, fabrics or protective equipment; infection from shared spaces or surfaces.
  • Equipment, timer, sensor, cooling, electrical or power failure; unexpected exposure; difficulty exiting; or injury involving moving components.
  • Incorrect settings, positioning, timing, instructions or supervision, including mistakes by staff or clients.
  • Slips, trips, falls, impacts or other injuries while entering, leaving, changing or moving around the premises, and loss of or damage to belongings.
  • An unrelated or unexpected medical emergency during a session and delays in recognizing a problem or obtaining assistance.

Protective measures can reduce risk but cannot eliminate every possibility of harm. Injury may be temporary, serious or permanent; a severe incident can result in disability or death. Unexpected risks may also arise. This disclosure does not state how likely any particular event is or excuse unsafe practices.

6. SESSION INSTRUCTIONS AND MY RESPONSIBILITIES

Before exposure begins, I will receive and follow instructions for the equipment, permitted position and settings, exposure time, required protection, stopping the session and obtaining assistance. I will ask if any instruction is unclear.

I agree to:

  • Use the eye protection specified by Red Life for the equipment and follow its correct-use instructions. Closed eyes are not a substitute for required protection.
  • Follow the equipment-specific exposure limits. Appointment length is not permission for that entire period of light exposure.
  • Leave controls, timers, protective devices and settings as instructed; not bypass safeguards or increase exposure on my own.
  • Disclose products applied to my skin where relevant and not proceed with an unresolved photosensitivity concern.
  • Not participate while impaired, unwell, overheated or otherwise unable to participate safely.
  • Tell staff if I need help entering, positioning myself, stopping or leaving the equipment.
  • Stop and seek assistance promptly for excessive heat, burning, pain, dizziness, faintness, nausea, visual changes, breathing difficulty, panic or another concerning symptom.
  • Report equipment faults, unsafe conditions and reactions, including reactions noticed after leaving, as soon as reasonably practicable.

I may stop a session at any time. I am not required to continue because I have paid, signed this agreement or previously tolerated a session. Red Life may also stop, postpone or decline a session for a documented safety concern. Related financial rights remain governed by applicable law and the separately disclosed purchase terms.

7. VOLUNTARY ASSUMPTION OF RISK

With the information in this agreement and an opportunity to ask questions, I voluntarily choose to participate. Subject to section 9, I accept the risks described above and other risks reasonably connected with these sessions, including risks that appropriate precautions cannot fully eliminate.

I understand that my inaccurate information, failure to disclose changes, disregard of instructions or equipment misuse can increase risk and may affect responsibility for resulting harm.

This section does not transfer Red Life's mandatory legal obligations to me or mean that I have agreed to undisclosed material hazards or knowingly unsafe operation.

8. LIMITED RELEASE, INCLUDING NEGLIGENCE

In consideration of Red Life permitting me to participate, and subject to section 9, I release the Released Parties from claims I may have for personal injury, illness, death, property damage or related loss arising from the sessions, to the extent that the release is lawful, reasonable and enforceable.

THIS RELEASE INCLUDES CLAIMS BASED ON THE ORDINARY NEGLIGENCE OF A RELEASED PARTY, INCLUDING NEGLIGENT INSTRUCTION, SUPERVISION, OPERATION OR MAINTENANCE, FAILURE TO WARN OR TAKE PRECAUTIONS, AND PREMISES-RELATED NEGLIGENCE, BUT ONLY TO THE EXTENT THOSE CLAIMS MAY LAWFULLY BE RELEASED.

This release applies only within its stated scope. It does not bind another person in respect of an independent right that I have no authority to release.

9. RIGHTS AND CLAIMS NOT RELEASED

Nothing in this agreement excludes, restricts or waives:

  • Any non-excludable statutory condition, warranty, duty, right, benefit or remedy, including under Nova Scotia's Consumer Protection Act.
  • The statutory condition that consumer services be performed skilfully, efficiently and competently, or liability and remedies for its breach that cannot lawfully be limited.
  • Applicable statutory cancellation, rescission, refund, renewal or other consumer rights.
  • Rights and obligations under applicable privacy, human rights, health, safety or other mandatory legislation.
  • Claims arising from fraud, intentional misconduct, gross negligence, reckless conduct, sexual misconduct or abuse.
  • The right to contact a regulator, report a safety concern, make a complaint or obtain legal advice.

These exceptions prevail over every other provision. An assumption of risk, acknowledgment, release or other term cannot be used indirectly to remove a right protected by this section.

10. RESPONSIBILITY FOR HARM I CAUSE

I remain responsible, to the extent provided by law, for injury or property damage I cause through my intentional misconduct, reckless equipment misuse or knowingly false safety information.

This is not an obligation to pay for Red Life's own negligence or statutory breaches, defend a Released Party, reimburse the costs of my good-faith complaint or legal claim, or compensate anyone beyond my lawful share of responsibility.

11. PURCHASE TERMS AND PRIVACY

This agreement is not a membership contract or authorization for recurring charges. Prices, billing, renewals, booking limits, cancellation, credits and refunds must be addressed in separately disclosed purchase terms consistent with applicable law. Signing this agreement does not forfeit a mandatory refund or authorize an undisclosed charge.

Red Life collects relevant identity, contact, screening, consent and session information for booking, suitability review, safe service delivery, customer support, incident handling and lawful recordkeeping. Relevant information may be handled by service providers or disclosed where necessary and lawful for emergency assistance, professional advice, claims or legal requirements.

Red Life remains responsible for its applicable privacy obligations. Its privacy notice must explain relevant practices, providers, retention and how to request access, correction or assistance. I may contact hello@redlifewellness.ca with questions. Refusing necessary screening information may prevent Red Life from providing a session, but does not remove my statutory rights.

This waiver does not release privacy or security claims, authorize unrelated uses of health information, or constitute consent to promotional messages, photographs or testimonials. Optional uses require an appropriate separate choice.

12. ELECTRONIC ACCEPTANCE, FUTURE SESSIONS AND WITHDRAWAL

By selecting 'Accept and sign' while signed into my account, I adopt the full name displayed on the acceptance screen as my electronic signature and intend to sign this version of the agreement. Red Life may retain an accurate electronic copy identifying the accepted document, acknowledgments, displayed name, account identity and acceptance date and time, and will make an accepted copy available to me.

This agreement applies prospectively to the sessions within its stated scope after I accept it. It does not retrospectively release an existing incident or claim. Red Life cannot replace the text I accepted with different terms without obtaining any required new acceptance.

Repeat participation remains subject to current screening, updated risk information and session instructions. This agreement does not permit an old screening or signature to override changed circumstances.

I may decline future participation or withdraw consent to the session, including during exposure. Withdrawal does not retrospectively cancel participation that already occurred or authorize deletion of records lawfully required for claims or other obligations. Applicable financial and privacy rights remain protected.

13. GOVERNING LAW AND SEVERABILITY

Nova Scotia law and applicable Canadian federal law govern this agreement. Disputes may be brought in the competent courts of Nova Scotia, subject to any mandatory right to proceed elsewhere. This agreement does not impose arbitration, a class-action waiver or a shortened statutory limitation period.

If a provision is invalid or unenforceable, it is ineffective to that extent. The remainder continues only insofar as legally permitted. Section 9 always prevails.

Cancellation & No-Show Policy

Cancellations must be made at least 24 hours before the session.

Cancellations made less than 24 hours before your session are considered late cancellations and your session credit will be consumed.

Clients who do not arrive for their scheduled session will have their session credit consumed.

Membership Fair-Use

Red Life 12 Membership includes up to 12 sessions per monthly billing period. Unused membership sessions do not roll over. Membership sessions are separate from purchased session credits.
